This Privacy Policy describes our policies and procedures on the collection, use and disclosure of your information when you visit our website, use the femfit App and access JUNOFEM services associated with educational material, marketing and purchasing.

Your pelvic floor health is really important to us. Improvement comes from correct exercise technique and completing the programmes. If we detect that your technique is not correct, we will contact you at the email address you use to login to the femfit App.

We use your personal data to provide and improve our services. By using our services, you agree to the collection and use of information in accordance with this Privacy Policy.

1. Definitions

For the purposes of this Privacy Policy:

You (or “Your”, "you") means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

 

JUNOFEM (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to JUNOFEM Limited, Level 6, 70 Symonds Street, Auckland 1010.

App means the software program provided by the Company downloaded by you on any electronic device, named femfit.
 

Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
 

Account means a unique account created for you to access our Service or parts of our Service.
 

Website refers to JUNOFEM, accessible from www.junofem.com

 

Service refers to the App or the Website or both.
 

Country refers to New Zealand

Service Provider means any natural or legal person who processes the data on behalf of JUNOFEM. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of JUNOFEM, to perform services related to the Service or to assist JUNOFEM in analysing how the Service is used.

Third-party Social Media Service refers to any website or any social network website through which a user can log in or create an account to use the Service.

Participant Information and Consent Form (PICF) is a form from a research organisation, and signed by a participant, describing how information will be managed for those who are enrolled in a clinical study.

Personal Data is any information that relates to an identified or identifiable individual.

Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
 

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
 

Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

2. Data we collect and how we use it

2.1 Personal Data

While using Our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to:

  • Your name

  • Physical Address

  • Email address

  • Usage Data

  • Survey data

 

JUNOFEM may use Personal Data for the following purposes:

  1. To provide feedback on pelvic floor exercising technique. If we detect that your pelvic floor exercising technique is not correct we will attempt to contact you either through the App, or via the email provided when registering for use of the App.
     

  2. To manage your Account: to manage your registration as a user of the App and facilitate reset your password if required.
     

  3. To manage delivery services: to send you a femfit device and keep you informed of delivery status.
     

  4. To manage your requests: to attend and manage your requests to us.
     

  5. To contact you: by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
     

  6. To send you marketing communications about:

    1. Us and our goods and services; or

    2. Our business partners and their goods and services that might be of interest to you, including information about promotional offers, contests, rewards and upcoming events. This information may be delivered to you via SMS, email, or personalised website experiences
       

   7. To facilitate third parties communicating with you about: our goods or services that might be of interest to you.
 

   8. To improve your experience with our goods and services: this could be in the form of surveys or us soliciting feedback from you on features and performance of our services, or proposed services.
 

   9. To provide feedback on symptom resolution to you: Survey data is used to provide you with feedback on symptom resolution as you progress.
 

  10. To enable improvements through research: Survey data is used to provide us with feedback on symptom resolution. We use this data for research purposes to learn what activities contributed to changes in symptoms.

You may opt out of receiving marketing communications from us at any time by following the opt out instructions provided in such marketing communications, or by contacting our Privacy Officer. Where you receive marketing communications from us through multiple channels (e.g., SMS, push notifications and email), you will need to opt out from each of those channels by following the instructions provided in such marketing communications or by contacting our Privacy Officer.

2.2 Usage Data 

Usage Data is collected automatically when using the Service.

Usage Data may include information such as your Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When you access the service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

We may also collect information that your browser sends whenever you visit our service or when you access the service by or through a mobile device.

We use Usage Data to monitor the performance of our services and enable us to perform testing of functionality such as correct display of our website pages on your browser version, correct playback of our embedded videos. Usage Data also helps us understand what you find interesting and how you came to use our services.

 
2.3 App Data

 

While using our App, we may collect:

  • actions associated with you using the user interface

  • values obtained from sensors inside the femfit device

  • text entries and selections you make in the diary pages

  • date and times you use the App and a femfit device

  • femfit device details including serial number, firmware version, user settings and battery information

  • history data about performance from performing exercises

  • programme selection choices you make and status of the programme such as current day

  • App and group settings.

 

We use this information to provide key features of our service such as feedback on technique and compliance to a regular exercise programme – both key parameters to a strong pelvic floor.

JUNOFEM may use App Data for the following purposes:

  1. To provide feedback on pelvic floor exercising technique. See Personal Data use above.
     

  2. To provide and maintain our service, For example, us knowing that you paused your workout helps us (and our algorithms) process your sensor data to derive pelvic floor activation pressure values and explain why we have a longer duration for an exercise then normal. A notification that a session has been processed should follow a notification that a session has been completed – this gives us evidence that the data transfer and processing systems are completing their tasks.
     

  3. To manage your requests: App data can help us understand if something has gone wrong, for example you are accessing a programme that is not the appropriate programme for you, or you are on the incorrect workout day.
     

  4. To trigger sending you communications: for example, by detecting that you are in week 4, we can trigger an email about how next week you will be changing posture and what to expect when this happens.
     

  5. To improve your experience with our goods and services
     

  6. To improve our products and services, including through research and development.
     

  7. For research purposes to improve the services for you, for other users of our services, and to generate anonymised aggregate data for educational purposes.

 

 2.4 Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track the activity on our Service and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyse our service.

You can instruct your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if you do not accept Cookies, you may not be able to use some parts of our service.

Cookies can be “Persistent” or “Session” Cookies. Persistent Cookies remain on your personal computer or mobile device when you go offline, while Session Cookies are deleted as soon as you close your web browser.

3. Sharing your Data

We may share your personal data in the following situations:

  1. With Service Providers: We may share your Personal Data with Service Providers who need this data to provide a service to JUNOFEM. An example is sharing of your data with Shopify to manage your order, with a courier company to manage your delivery, and with SalesForce to manage your customer journey. We also may share your data with Service Providers such as customer.io and SendGrid to facilitate sending you email communication to you from JUNOFEM.
     

  2. For Business transfers: We may share or transfer your Personal Data in connection with, or during negotiations of, any merger, sale of JUNOFEM assets, financing, or acquisition of all or a portion of our business to another company.
     

  3. With Affiliates: We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include any other subsidiaries, joint venture partners or other companies that we control or that are under common control with us.
     

  4. With Business partners: We may share your Personal Data with our business partners to offer you certain products, services or promotions.
     

  5. For marketing purposes: Like most businesses, marketing is important to our ongoing success, and from time to time, we may share your Personal Data with third-party service providers to manage providing you with marketing materials that may be of interest. This may include:
     

    1. Marketing materials in relation to offers, specials, other products and services that we, or affiliated business partners provide.

    2. Excluding you from receiving marketing material which we believe is not relevant to you.

    3. Targeted advertisements on third party websites or social media platforms, such as behavioural advertising and remarketing campaigns, in accordance with their respective advertising policies.

6. With other users: when you share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside. If you interact with other users or register through a Third-Party Social Media Service, your contacts on the Third-Party Social Media Service may see your name, profile, pictures and description of your activity.

 

7. A number of Universities are using our Services to support research studies and clinical trials with the goal of improving women’s pelvic floor health. If you are registered as a study participant and if you have completed a Participant Information and Consent Form (PICF), then JUNOFEM will share the information collected from your use of the Services with the research organization consistent with the PICF.

If you would like to revoke the sharing of your data with the research organization specified in a PICF, please email PrivacyOfficer@junofem.com.
 

8. Healthcare Clinics are using our Services to support the management of patients and their treatment programme.

If you have entered a Clinic Code in the femfit App, then we may share your name and exercise data with your clinic. At any time, in the App, you can choose to Shop sharing with your clinic.

If you are registered with a Healthcare Clinic as a patient and if you have completed a Patient Information and Consent Form (PICF), then JUNOFEM will share the Information Collected from your use of the services with the Healthcare Clinic consistent with the PICF.

If you would like to revoke the sharing of your data with the Healthcare Clinic specified in a PICF, please email PrivacyOfficer@junofem.com

4. Retention of Data

JUNOFEM will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our Quality Management System requirements, legal obligations, to resolve disputes, and enforce our legal agreements and policies. When you place an order with us, we will maintain your order information in our records unless and until you ask us to delete this information.

 

JUNOFEM will retain App Data for internal analysis purposes. One of our key goals is to improve pelvic floor health globally – and evidence-based research is at the heart of this commitment. We will retain your App Data relating to pelvic floor muscle activities, engagement with the femfit App and communications and symptom resolution progress. If you delete your account, then this App Data will still be retained, but it will be de-identified. The de-identified App Data will continue to be used for research purposes. Retained App Data is particularly valuable for us to help with improving our service for the benefit of those suffering from urinary incontinence through facilitating the assessment of the effectiveness of exercise programmes, impact of adherence and rate of change in pelvic floor muscle activity.

5. Access to and correction of Personal Data

We will take reasonable steps to ensure that any Personal Data we use is accurate, up to date, complete, relevant, and not misleading.

You are entitled to access your Personal Data which we have collected. This must be done by request to our Privacy Officer (email PrivacyOfficer@junofem.com).

 

We value your Personal Data being accurate. You may request the correction of your Personal Data should there be any information that is inaccurate. To request a correction of your Personal Data, send us a statement of correction for the information to our Privacy Officer (email PrivacyOfficer@junofem.com).

6. Transfer

Your information, including Personal Data, is processed at JUNOFEM’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

JUNOFEM will only transfer your Personal Data outside of New Zealand if we reasonably believe that comparable safeguards are in place to protect your Personal Data.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

7. Security of your Personal Data


The security of your Personal Data is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

8. Links to other websites
 

Our Service may contain links to other websites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

9. Changes to this Pricacy Policy


We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

We will let you know via email and/or a prominent notice on our service, prior to the change becoming effective and update the “Last updated” date at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
